Terms and Conditions

These General Terms and Conditions apply to accommodation and other contracts between Yasos Gastein GmbH, Alexander-Moser-Allee 21, 5630 Bad Hofgastein (Hotel „Das Gastein“, hereinafter referred to as the „Hotel“), and its guests. In addition, the „General Terms and Conditions for the Hotel Industry 2006 (AGBH 2006)“ in their respective valid version shall apply.

1. Conclusion of contract

The accommodation contract comes into effect upon the hotel's acceptance of the guest's booking. If the booking is made via our online booking system (DIRS21) or via third-party booking platforms, the contract comes into effect upon confirmation of the booking. Booking confirmations transmitted electronically shall be deemed to establish the contract.

2. Services, Prices, Included Services

The scope of the contractual services results from the booking confirmation as well as from the offers valid at the time of booking. The stated prices are final prices including VAT and include the respective specified inclusive services (e.g., breakfast buffet, admission to the Alpentherme Gastein year-round, Gastein mountain railways in summer, mobility ticket, Gastein Card, Wi-Fi). The in-house underground parking (€ 6.90 per day) and the local tourist tax/spa tax are – unless stated otherwise – not included in the price and are to be paid on-site.

Arrival and departure

Booked rooms are available to the guest from 3:00 PM on the day of arrival. On the day of departure, rooms must be vacated by 11:00 AM. A later departure is possible subject to availability and prior arrangement.

4. Withdrawal and Cancellation Policy

For the cancellation of the accommodation contract, the provisions of the Austrian Hotel Contract Conditions (AGBH 2006) as well as the cancellation conditions displayed and confirmed during the booking process (DIRS21) or on third-party booking platforms for the respective rate shall apply. The terms and conditions communicated to the guest at the time of booking are decisive. We recommend taking out travel/cancellation insurance.

If the guest does not arrive on the day of arrival without an agreed later arrival time (no-show), the hotel is entitled to reassign the reserved rooms; any claim to the agreed fee shall remain unaffected in accordance with the 2006 Austrian Hotel Terms and Conditions (AGBH 2006).

5. Pets

Dogs are welcome upon prior notice. The fee is € 20 per day (excluding food). Dogs are not allowed in the wellness and restaurant areas (the winter garden is exempt from this rule). The guest is liable for any damage caused by the animal.

6. Payment

The hotel is entitled to request a reasonable advance payment or deposit at any time. Unless otherwise agreed, the invoice amount is due for payment upon departure. The payment methods accepted on site shall apply.

7. Liability

The hotel is liable for damages for which it is responsible in accordance with statutory provisions. The hotel is liable for brought-in property in accordance with Sections 970 ff. of the ABGB (Austrian General Civil Code). Any liability exceeding this is excluded to the extent permitted by law.

8. Applicable Law, Jurisdiction

Austrian law shall apply, excluding the conflict of law rules of private international law and the UN Convention on Contracts for the International Sale of Goods (CISG). The place of performance is the registered office of the hotel. The place of jurisdiction is the court with subject-matter jurisdiction at the registered office of the hotel; statutory jurisdictions shall apply to consumers.

9. Final Provisions

If individual provisions of these General Terms and Conditions should be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. They shall be replaced by a provision that comes closest to the economic purpose of the invalid provision.
